In the 15 years since Congress passed HIPAA, medical privacy and data security rules have become commonplace and govern the routine handling of patient information. Healthcare employers now face new challenges as their compliance with these evolving rules become the subject of employee complaints and lawsuits and patients gain stronger voices in the management of medical records. To be sure, OCR’s latest audit program has garnered substantial attention. However, on a day-to-day basis, healthcare organizations are dealing with more intense scrutiny over how they enforce their own policies by state and federal courts around the country. Moreover, HITECH requirements to report breaches affecting fewer than 500 patients have added additional pressure on healthcare employers and Business Associates to ensure that their policies and procedures are enforced and enforced fairly. HIPAA now is routinely invoked in a variety of lawsuits involving malpractice, law enforcement access, employee rights, and a host of other issues. That means healthcare organizations – the gatekeepers for medical records – are spending enormous resources on determining when they can and cannot release information because of the complexity of the regulations on both the state and federal levels. Another key development: The Justice Department has become more comfortable in enforcing the criminal penalties under HIPAA, meaning healthcare employees are subject to jail terms. Piled on top of that, advances in technology and pressures to reduce healthcare spending are compelling covered entities and Business Associates to adopt electronic health record systems and determine how to accommodate new consumer electronics in the workplace.
