HHS regulations establishing Accountable Care Organizations (ACOs) represent the next step in the movement towards adopting and leveraging electronic health records and electronically exchanging patient data. That means privacy and security officers will occupy an important seat at the table as healthcare organizations start establishing the real world parameters of data stewardship across multiple organizations and state lines.

The bottom line: the Nov. 2 regulations, which provide incentives for coordination of care, present new challenges in complying with HIPAA because healthcare providers may have to adjust their existing HIPAA privacy and security policies to work with other covered entities.

For example, providers may need to re-evaluate what constitutes a medical record when it is maintained across multiple organizations. Moreover, coordination of care will require clear lines of responsibility and oversight for security and breach response.

The ACO program also will not pre-empt state laws which means that participating providers will have to accommodate patient protections stricter than those under HIPAA and other laws affecting medical privacy.

As important, the emphasis on patient-centeredness should prompt covered entities to re-examine how they communicate and manage authorizations from patients using their EHR systems.

THE FACULTY

Adam Greene is a veteran health law attorney and a former key regulator at the U.S. Department of Health and Human Services, where he played a fundamental role in administering and enforcing HIPAA privacy, security, and breach notification rules. At HHS, Adam was responsible for determining how HIPAA rules apply to new and emerging health information technologies. He was instrumental in the development of the current enforcement process.

 

Dennis Melamed, Mr. Melamed is editor and publisher of Health Information Privacy/Security Alert and the monthly HIPAA & Breach Enforcement Statistics. He is an adjunct professor at the Drexel College of Medicine where he teaches courses on health data stewardship, federal regulation of biomedical research and trends in medical device regulation. Dennis works extensively as a regulatory affairs analyst and researcher and has served as consultant on health data stewardship issues for a number of organizations, including the National Governors Association's State Alliance for E-Health.
